Buying a second hand rib

I am just going to part with over 20 k on a rib - private sale - On completion i will get the vendor to sign my MCA bill of sale and also disclaimer to say that he has no Hp or outstanding loans secured on rib. Say 6 mths down the line Hp turn up & say they have an intrest or own % of boat - where do i stand ?

Chill out - I will when i hand over my very hard earned cash ( no loans or hp ) and am satisfied that the rib is all mine. Did you shit yourself when you handed over your dosh or maybe you made all the checks first and everything was A OK !!!!!!!!!!!!!!

As it goes I bought a car recently which turned out to be a ringer so I totally understand that you want to cover all possible situations before you hand over your cash.

I have studied contractrual law at uni. My take on the situation would be that the company who effectivly "own" the boat may be able to take it back, but becasuse the seller has told you (in writing) that there is nothing owed on the boat you should be able to claim damages against him for the money you have lost.....

I don't think you can prove that there is no outstanding finance on the boat by doing a HPDI check or similar!

I guess the best way of ensuring that the vendor is genuine is to see proof that the house you are buying it from is his and ask to see his reciept for the boat! If it says paid cash by your vendor (presuming it came from a business) then there ain't a finance agreement on it. You could also ring the original vendor if your still unsure. If he can't produce a verifiable original reciept then walk away.

keep a copy of the advert that first attracted you to the boat in case it turns curly.

You can do a similar HPI check through bOAT Auto Trader £4.50 not gauranteed ! I have ASKED FOR PROOF OF OWNERSHIP AND LAST RECEIPT WHEN HE PURCHASED THE BOAT! Original or previous vendor excellent advice ! Thank you

Im sure it will all be fine but even an HPI check can't be totally relied upon. My car came back clean; seems the original owner didn't tell the insuance company when he crashed it. As long as everything's in writing you can't go too far wrong.

Mr kk@decor82.fsne - there's some true words said here. When I bought, I mitigated the risks by buying from someone I knew, and I had got to know many of his friends so effectively references had been taken! If you're buying from someone you've never met before then the advice to use a solicitor as an intermediary may have some value. I think that using a thug as an intermediary may have more practical use though... you could make it clear to the vendor that if there's any future comeback, he may lose his kneecaps. The question to you is... are you suspicious of the vendor? And why? If you are, then walk away from the sale. You're certainly right to ask for paperwork - there should be an original bill of sale for the boat and for any additional equipment fitted. There should be an engine log book. And if the current owner isn't the first owner, ask for all the receipts in the chain. The more that's missing, the more suspicious the vendor is.

Boats aren't as straightforward as cars, it's a jungle out there! You need to keep your wits about you and trust in your instincts about people. And as for the banter... many a true word said in jest.
