I'd get a new solicitor then! Your "contract" exists with the dealer not with evinrude - you need to return the engine to the dealer demanding a full refund/replacement as the goods are not fit for...

No that's his problem not yours. The sale of goods act is quite clear - the dealer who sells you the engine NOT the manufacturer is responsible for the quality of the goods.
