Obviously go for the Refund, but the law is on your side with regard the difference between the refund and buying new kit from somewhere else.

I was reading an artical in my local News yesterday with someone that had Ordered and paid a deposit for a new car, when the car turned up at the showroom they wanted £500 more than the agreed price. When the customer said he wasn't going to pay the £500 they refused delivery of it untill the new price had been met.

The local Paper's consumer department got involved and basicly sent a letter to the dealer saying that if they didn't sell for the agreed £10000 then the customer would demand his deposit back and that he would see them in a small claims court if there was any difference in price for the same car bought from another dealers. The car was delivered the next day

I would give the oppotunity to the company to deliver what they agreed to for the price they agreed to. It would possibly be a waste of time to ask this question again, but they are obviously aware of this thread now.

Failing this, ask for a refund of the outstanding monies to include the difference between the agreed sum and the cheapest you can get this kit for now. You have a moral and legal obligation to go for the cheapest price and send them some sort of evidence for the extra amount (£175).

Sit back and watch what happens. If they pay up that's a great result for you and saves face in the process. If not then your only course of action is the small claims court for the difference (assuming they've payed back all your money).

If they are awkward in dealing with this, then I think it's fair to warn others of this company and leave some form of feedback here.

They are taking the Michael name and shame them!! The Sale of Goods Act provides that goods must be supplied within a "reasonable time" - 4 months is clearly unreasonable. If they are solvent then you need to pursue them. Send them a 'letter before action' I am happy to help you. If they do not refund you the outstanding amount in the timescale set then pursue them through the small claims court.

Does the sale of goods act apply in this case?

I'm not sure the SOGA applies as the only(!) problem is they haven't been delivered and when you get them they may work correctly.

It may be more relevant to refer to: Buying goods - your rights which contains the following (my colours):

Delays in deliveries

If you have been given a date for delivery, your goods must be delivered by that date. If they aren't delivered by then, the trader will have broken their agreement with you, and you are entitled to ask for compensation.
