I've unpacked it and checked it over, it turns over well, selects gear, and is generally quite clean. The air filters missing , and the prop and gear box is a bit tatty. But still attached to the rest of it, a couple of months ago he told me that DHL had broke the gear box off???????

I should be able to start it up tommorow, see how it goes.

Did that model have an air filter? Some don't.

Its a 2000 model?

Didn't look for any fittings for the filter... it was getting cold and dark.

Theres also a blue button on the fuel pump, anyone know what it does... couldn't find anything in the manual.

Manual prime at a guess. Is it in the middle and does it pump fuel if you prod it?

If he's thinking of taking legal advice I hope he takes into account the fact that he's been blocked from trading on ebay several times.

I love it when people try this one.

Just proves to me what complete **** artists they are.

Hopefully his lawyer knows his stuff... and refers Mr Cooper to the case of Moran v Heathcote (2001) WL 98063 (QBD)

where the judge refers to Lord Denning MR in Fraser v Evans where he states

"The court will not restrain the publication of an article, even though it is defamatory, when the defendant says that he intends to justify it or to make fair comment on a matter of public interest. That has been established for many years since Bonnard v Perryman [1891] 2 Ch 269."

Assuming that what has been posted is true - then it is most certainly in the public interest to identify unscrupulous traders.

The additional problem encountered in Moran v Heathcote is that the damage is virtually unquantifiable on the internet. It may be that nobody read the post. It may be that thousands of people of read the post. It may be that one person read the post thousands of times to make it look like thousands of people had read the post. So how would the court decide how much to award him?

Cheers,
WMM

Is there not a case for contacting Ebay at this stage and asking for him to be barred from creating new Ebay accounts? Or are they not interested? They could filter him out fairly easily by his registered address if they wanted to.

I have used moneyclaimonline for a variety of bad payers and have even taken a business to court for just £15.00 - and won (they even got a CCJ and Balifs were sent in)

It's easier than you think, sending Balifs through this service to recover goods and saves you the trouble of going in and getting angry.

He's obviously got some gear so send the Balifs in to recover your costs.

Every time he loses in court it will cost him all expenses so get on to him now before he's living in a cardboard box under M&S
