Help Please - Lost Motor

Hi all,

My O/B was being serviced for the first time in Monmouth County, NJ. I just got a call from the shop that the warehouse, and all the contents were completely destroyed/washed away as a result of Hurricane Sandy. He told me that his insurance company said that the owners' insurance will cover the lose. My boat and motor are not insured.

Where does that leave me?

It is a brand new, 15HP Honda. it was in the shop for 20 hour servicing, and winterizing.

He called me back and said that it isn't covered under insurance, because it is an act of God. He also said that he doesn't own the property, the township does. To which I said, but you pay rent.

he said he will try to include the motor under his claim.

I feel selfish being so concerned about something so materialistic. but I don't have much money, and this motor was a really big purchase for me, and meant to spend some quality time with my young daughter.

I have a bad feeling I'm out this money. And I'm still going to be paying it off for the next 3 years.

I'am sure if you run a business you would have insurance to cover customers property whilst in your pocesion,(assuming its booked in as a proper job etc)Lots of work shops are rented , don't know about the act of gods ploy, but most ins company's make you fight for a successfull claim.

really sorry to hear that BB and I'd guess that advice from this side of the pond may not be relevant on your side. If it was me I'd be down at the shop with my camera taking plenty of pic's and seeing if the shop, warehouse and contents really are destroyed/washed away. Good luck with it.

i would have to agree with you. But I'm not sure what steps to take. I don't have the money to hire a lawyer. And besides my auto and home, I don't have an insurance company to work with me on this.

How would you pursue it?

BB did you purchase the engine from the people who serviced it ? if so stop your payments and put the money to one side until you get some sound legal advice .

Yeah...I'd say they are all gone. Plus, that area is still closed off. The guy said that only the concrete foundation is there. Everything else was dragged out to sea. Still, can't the insurance companies or other agencies retrieve all the stuff from the ocean?

Just out of logic whichever side of the pond you are on, ... I would expect the machine shop to be liable. They must surely take precaution for the safe keeping of your equipment whilst in their custody. How possible that is given the circumstances I cant say, you need to find that out, since, they or the insurers may be using that as a convenient cover to avoid any liability. Do you have any receipts or any correspondance proving you dropped the boat off ?

I have an estimate for the servicing, but it doesn't include any details about the motor. But I have plenty of receipts (and registration) from when I bought the motor, though. I did ask him on the phone if he has my motor information, and he said all his files are gone, but he has the data on his computer.

It would be better to correspond with him by email from now on then because it is always traceable. It may take some time but I'm sure it will work out for you in the end, even the dealer at the beginning of your thread did say that he would try to claim it back on his insurance, obviously he will be under a lot of pressure himself with after effects of this terrible disaster.

God's acts pics speak for themselves, what a $$$$$ mess, assume shop has a minimum inssurance for their belongins, most customers engines comes in, goes out real fast so probably not covered or can be added to his main inssurance. Vandalism, terrorism, acts of God are not covered under normal inssurances fees. What a pitty.

Over this side of the pond a lot of home insurance policies include legal protection. Have you checked yours to see if it's included? It may be a way to get legal help.
