The problem is tweekable however it requires alterations to the boat to enable the engine to move up the transom.
Withholding payment puts the aces firmly in your hands

If the engine can be moved up to a satisfactory height then i think the xl engine is probably good for your boat as your previous opti did seem to sit deep in the water at rest

Its how the alterations are achived that will be the deciding factor If they can be done at all

Thank you all. Would love further input on whether to reject engine or how to guide the builder in the necessary modifications.

Do the photos and the speed / revs stats give us any clues or more / less cause for concern?

If this was my boat and I wanted an xl I would be getting a new transom or it filled in professionally if possible. the engine needs to go up still and it is asking for saddle problems down road you would think.

I would be putting a long shaft on if you were happy with old engine performance but I do agree the powerhead is low so the juice may be worth the squeeze to mod the boat for it....your call. The boat builder I assume designed it that way rather than someone breaking out a grinder and lowering the transom, possible ofcourse.

I guess they need to build up the transom so that the engine can be mounted higher up. More of the engine will crash into the transom.
I would be examining to see if the long shaft would work better with the boat and a frame as it is.
Without seeing the boat it’s hard to be sure but for my money a long shaft would be much more suitable.

The boat didn't need modified to suit the Opti. I wouldn't buy a second hand boat that had had the transom "built up" to compensate for a mismatched engine.
It looks "wrong" and this will make it a pain to try and sell when the time comes.

If they wanted 13k of my money I'd want the job done properly...ie the right engine fitted or I'd be looking for a huge discount because of the devaluation of my boat.

If there is mechanical scope to drop that engine 4" then it needs a long shaft.

Steady on!
I wouldn't be considering modifying my boat to fix the engine supplier's problem.
I also wouldn't keep using it, it can be perceived as acceptance.

Call Lee Fairweather at Fairweather Marine. He built the boat and will be able to confirm transom height.
Get this in writing before going back to your engine supplier.
