Ice-cream boat question

This is a serious question (I am sober). Would an ice-cream boat need to be coded (if operating in the Solent)?

Tim, one already runs out of Hamble Point and I guess you would also need to consider a food licence? Also what about the "ice cream van/boat" tune- Captain Pugwash??

I used to own and run a little ice-cream business which I set up when I was at school, in Norfolk. Quite like the idea of an ice-cream boat in Portsmouth Harbour

Going more serious back to coding- here are some of the regs which would support coding as receiving money if I read it correctly

- “small commercial vessel” means a small vessel which is not a pleasure vessel;

- In these Regulations, “pleasure vessel” means—

(a) a vessel which—
(i) is owned by an individual, and
(ii) at the time it is being used —
(aa) is used only for the sport or pleasure of the owner or the immediate family or friends of the owner, and
(bb) is on a free voyage or excursion;

(b) a vessel which—
(i) is owned by a body corporate, and
(ii) at the time it is being used—
(aa) is used only for the sport or pleasure of the employees or officers of the body corporate, or their immediate family or friends, and
(bb) is on a free voyage or excursion;

(c) a vessel —
(i) which is owned by or on behalf of the members of a members’ club,
(ii) which, at the time it is being used, is used only for the sport or pleasure of a member of that club, his immediate family or his guest, and
(iii) for the use of which no payment is made other than a payment into the funds of the members club which funds are applied for the general use of the members club.

(2) In this regulation, “free voyage or excursion” means a voyage or excursion in respect of which—
(a) no money is paid and no goods or services are provided to any person other than the owner of the vessel engaged in the voyage or excursion; and
(b) the owner of a vessel engaged in the voyage or excursion does not receive–
(i) money for, or in connection with, the operation of the vessel or the carrying of any person in the vessel other than as a contribution to the direct expenses of the operation of the vessel incurred during the voyage or excursion, or
(ii) goods or services other than goods or services which are used or provided on the vessel during the voyage or excursion.

Have these on the river at Christchurch - great when on the mooring in the summer or at anchor. Also out during the Bournemouth airshow........

No way either are coded ! No sign of any safety gear etc with a small Honda genny running a freezer

......... but great for a corneto however.........

Tim,

Firstly, thanks for posting that it has just reminded me how fortunate I am not to be anywhere near the busy south coast!

Secondly, I don't think anyone has actually answered the question fully. As I understand it you only need MCA coded if you are operating commercially outside categorised waters. Most of the solent is Cat C waters - so you can operate there unless you are hiring the boat out or carrying passengers in which case local authority licensing would apply. Of course there are probably some other sort of licenses required for selling ice cream to the public?

However, why is noone else already doing it in your target area? I'm guessing that it would only be viable on the warmest/sunniest/busiest days - is that not when your 'RIB trips' are busiest too? i.e. will it get in the way rather than compliment your existing activities?

Hi Tim,

Local Authority Licence for the Solent. Eastleigh Borough Council department that issues the licences also deals with Environmental Health - should be able to sort out your food hygiene certs as well!

Will need a nice big alternator and a 12 volt fridge as no petrol inboard engines allowed on coded boats.

As per the Blue, Yellow, Brown and NDP codes and MGN280 - unless an inboard petrol engined boat was operating before those codes came into practice.

Local Authority code (SASHMA) in the Solent is based on the Inland Code which is in turn based on the MGN280.

Petrol vapours from carbs etc etc.

what about a wash basin, soap and running water for food safety reasons unless ice cream vendors are exempt.,,mindst going by some of the ice cream vans in our area hand washing seems least of the worrys .

umm, not sure about no petrol on board, you couldn't run a wing engine without it, in a fixed tank maybe?, they change the rules every week by the sounds of it.
thinking about it there has got to be more to it than that otherwise you couldn't code an outboard boat
