Eupa I can quite understand why Jono just couldn't be bothered to answer your drivel anymore - you are on the verge of being a troll............

As far as the Selby crash is concerned - the load on the Land Rover was NOT illegal - it was well within it's towing limits.

http://www.hse.gov.uk/railways/selby/interim1.htm

Remember ALL lorries on EU roads have trailers and loads far in excess of their tractor units - a vehicle does NOT have to or need to be heavier than it's load!!!

What caused the Selby ACCIDENT was the driver falling asleep at the wheel at the wrong time in the wrong place - if there had been a crash barrier present those people would NOT have died and Gary Hart would NOT have gone to prison.

"# Since 1998\99, there have been 31 incidents involving motorists losing control of their vehicles and landing on the railway and obstructing the line. There have been a further four incidents involving vehicles coming from road over rail bridges. In this period, 4 vehicles have been struck by trains after motorists have lost control and a further 6 trains have struck vehicles obstructing the line as a result of vandalism or criminal intent. These figures include the recent incident at Great Heck."

These people were NOT sent to prison for doing exactly the same as Gary Hart - people just seem to have forgotten the word ACCIDENT these days.

How many people out there have driven whilst tired??? TRUTHFULLY!!!!!

# Vehicle/train issues
# Obstruction of railway track by road vehicles leading to collision occurs 2-3 times a year on average, whether through misadventure or (more often) through vandalism. The catastrophic consequences of this road traffic incident - which result from this unusual series of events - are wholly exceptional.

Also from the official report "Wholly exceptional"

Did Gary Hart mean to kill those people? Was he pleased he had killed those people? Would sending him to prison bring those people back?

It seems to me this really was a "wholly exceptional" ACCIDENT - ie NOT meant to happen!!!

Would he have been sent to prison if the trains had been late or he had hit a cow in a field - obviously not and yet the "crime" would have been the same - falling asleep at the wheel.

Maybe I shouldn't have opened this can of worms again but if there is one thing I HATE it's a hypocrite - to hear people criticise someone for having done EXACTLY the same themselves - just because they have got away with it does NOT make it right!!!

STICK TO FACTS Please!!!!!!!!!!

Gary Hart -claimed that HE HAD NOT FALLEN ASLEEP. He did admit that he lost control because the trailer started snaking. The road barrier was inadequate and he ended up on the line. His insurance company ( Fortis) paid 20 million quid in compensation and I believe another 10million after a judge decided that the barrier was adequate. Use the word "accident" with care
because people are always looking for excuses. He got 5 years and was directly responsable for the death of 10 people. Perahps if he had more experience of pullng trailers and /or ensuring the weight was more on the tow bar the trailer would not have snaked in the first place and the "accident " would not have happened. What is your experience with pulling trailers? would like to know where all your fountain of stupidity comes from

Jonathan

Why dont you tell everybody how many people that guy killed whilst towing with a LR ( and overweight trailer)???- i,e answer the question.
And check your facts - go to www.landrover.be ( dated jan 2005 ) - there is no mention of towing weights as regards the Discovery ( go to specifications-if you find it difficult to follow just ask me)- and the resaon for that is that legislation is changing as regards Jono type people having accdents

With tremendeous rspect ,

Also there was NO barrier!!! FACT!!!!
Oh yes - then what was a judge looking at the requests of the insurance company- thin air

He fell asleep at the wheel - FACT Nobody was there -further witness's say the LR was being driven normally

- the accident was NOT caused by a snaking trailer - FACT!!!!

If you saw the reconstruction- using idential equiptment - you will see it was with a trailer having the axles undeneath the body. These are very unstable and prone to snaking- as distinct from trailers having the body between the wheels. But of course you are such an expert with towing trailers.....
There are no witnesses statement to the contrary and in fact the conclusions as regards the actual cause are very subjective

How many more FACTS do you want!!!
Try and read -or do you need glasses as well as a new brain?. go to www.bbc.co.uk /search /selby train accident

just tell me how many hours you have spent towing trailers in excess of 3000 kgs ...

jonathan

You really are a pratt. Whats the point debating (?) this point. You have a link to the hse report. Are you so disrespectfull to the people that were involved in this tradegey that you seem to think you know best.

The guy was proven to have fell asleep at the wheel. He was also playing with a mobile phone prior to the incident. He was on a section of motorway that does not have a gradient so therefore he did not pick up speed. And yes I have thousands of hours pulling trailers, its my job.

Franklly I find your manner on this topic offensive to say the least. I saw the accident 24 hours after and it is something I will allways remember.

Perhaps in respect for those directly involved in this tradegy we should get back to the original topic, either that or let the forum moderator sort it out

Martin
